Affiliate Terms

These terms apply to the affiliate program of Lumenary Vision, run by Sebastian Koch, Grewenbrink 3A, 33619 Bielefeld, Germany ("I", "me"). They apply between me and every person or company that takes part in the program ("you").

1. The program

In the program you share my digital film profiles with your audience through a personal tracking link and earn a commission on qualifying sales. Links, tracking, reporting and payouts run through the service UpPromote. You take part by applying, and I decide on every application. There is no claim to being accepted.

2. Who can take part

You must be at least 18 years old and run your own channel, such as an Instagram account, a YouTube channel, a blog or a newsletter. The information in your application has to be true and complete. One person takes part with one account.

3. Commission

You earn 30 % commission on the value of every qualifying order that is placed through your link. The value is calculated after discounts and without taxes, as recorded by the tracking system. An order counts if it is placed within 30 days after the click on your link.

A later click on one of my ads does not cancel this. A later click on another affiliate's link, or the use of another affiliate's code, does: in that case the commission goes to the other affiliate.

4. What does not count

No commission is paid for orders that you or people close to you place yourselves, for orders that are cancelled, refunded or charged back, for orders paid completely with a discount or gift code, and for orders that come about through a breach of these terms or through fraud.

5. Approval and payout

A commission becomes payable 30 days after the order, once it is clear that the order stays. Payouts are made once a month for all approved commissions from 50 euros upwards, to the payment account you give me, through the payout method offered in the program. Amounts below the minimum carry over to the next month.

You are responsible for taxes on your commissions. If you are a business, I need the details required for a proper invoice or credit note.

6. Rules for your promotion

Tag my Instagram account @lumenaryofficial in every post and story about my products.
Mark your posts as advertising where the law or your platform requires it. This is your responsibility. In Germany, a post with an affiliate link or a free product generally has to be marked, for example with "Werbung" or "Anzeige" or with Instagram's paid partnership label.
Describe the products truthfully. Claims about features, compatibility or availability have to match what the product page says.
No spam, no unsolicited mass messages, and no paid search ads on my brand name or my product names.
No coupon, cashback or deal sites without my written agreement.
Use my logo and images only as I provide them for this purpose, and do not create the impression that you are me or that you speak for me.
Do not share, resell or pass on product files. Every product is licensed to the buyer personally.

What works: most sales come from creators who talk about the product properly and show before and after edits, for example in stories with a link sticker to their personal link, in posts or in videos. How much you earn depends on how well you present the product. I do not promise any particular level of commission or sales.

If you like, we can also publish a post together as an Instagram collab post, for example for a special edit or a series, so that it shows on both profiles.

7. Free copies and featured photos

I give some affiliates a free copy of a product. The code is issued to one named person, works once and cannot be passed on or resold. A free copy is not a commission and not a payment. It may have tax consequences for you, which are your responsibility.

If you send me photos you edited with my products, I may show them on my website with your name and a link to your post, but only the photos you have agreed to. You keep all rights to your photos. I host the images myself and take them down when you ask. I will not use them in advertisements without asking you first.

8. Data protection

I use the information from your application and the data in the program only to review your application, to run the program and to pay you. UpPromote processes the data of affiliates for tracking and payouts. More is in my privacy policy.

9. Duration and ending

The agreement runs for an unlimited time. You and I can each end it at any time with a message by email. I can block your account straight away if you breach these terms. Commissions that were earned before the end and are valid under these terms will still be paid, except in the case of fraud.

10. Changes

I can change these terms for good reasons, for example when the program or the law changes. I will tell you by email at least 30 days before a change takes effect. If you do not agree, you can end the agreement before then. If you keep taking part after that date, the changed terms apply.

11. Liability

I am liable without limit for intent, gross negligence and for injury to life, body or health. In other cases I am liable only for the breach of essential contractual obligations, and then only for the damage that was foreseeable and typical for this kind of agreement. I do not promise any particular level of commission or sales.

12. Final provisions

German law applies, without the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country where you live stay unaffected. If one of these provisions is invalid, the others stay valid.
